About personal safety protection order

The personal safety protection order is an important system established by the Anti-Domestic Violence Law of the People's Republic of China, which can effectively prevent and stop the occurrence or recurrence of domestic violence.

The Anti-Domestic Violence Law of the People's Republic of China stipulates that if a party suffers from domestic violence or faces the real danger of domestic violence and applies to the people's court for a personal safety protection order, the people's court shall accept the application. After accepting the application, the people's court shall issue a personal safety protection order within 72 hours or reject the application; in urgent cases, it shall be issued within 24 hours.

After the people's court issues a personal safety protection order, it shall be served on the applicant, the respondent, the public security organ, and the residents' committee, villagers' committee and other relevant organizations. The personal safety protection order shall be executed by the people's court, and the public security organ, residents' committee, villagers' committee and other organizations shall assist in its execution.

According to the "Anti-Domestic Violence Law of the People's Republic of China", a personal safety protection order may include the following measures: prohibiting the respondent from committing domestic violence; prohibiting the respondent from harassing, stalking, or contacting the applicant and his or her relevant immediate family members; ordering the respondent to move out of the applicant's residence; and other measures to protect the personal safety of the applicant.

The new judicial interpretation expands the interpretation of other measures, stipulating that: the respondent is prohibited from insulting, slandering, or threatening the applicant and his/her relevant immediate relatives by telephone, text messages, instant messaging tools, email, etc.; the respondent is prohibited from engaging in activities that may affect the normal life, study, and work of the applicant and his/her relevant immediate relatives within a certain range of the applicant's and his/her relevant immediate relatives' frequented places such as their residence, school, and workplace.
