Organizing cheating in the college entrance examination is a serious violation of the law

During the college entrance examination, criminals often post "exam-assisting" information online, claiming that they can provide test questions and answers for candidates. Little do people know that organizing candidates to cheat in national education examinations such as the college entrance examination, providing test questions and answers to candidates, and selling and using wireless cheating equipment are all serious illegal and criminal acts.

[Case] ​​During the 2019 college entrance examination, He Mouhao, a college student, posted an advertisement for "assisting with the exam" online, and 12 candidates from Guangdong, Shandong, Guizhou and other places paid him a "registration fee". He Mouhao contacted college students Nie Mouwu and Peng Moulin (He Mouhao's classmate) online, and the three of them divided the work and cooperated. He Mouhao was responsible for contacting and delivering test questions and answers, Nie Mouwu was responsible for solving the questions, and Peng Moulin was responsible for arranging the test questions, and cheated for 12 candidates during the college entrance examination. On June 8, the police took immediate action after receiving the clues and arrested He Mouhao, Nie Mouwu and Peng Moulin on the spot. The three were sentenced to fixed-term imprisonment of two years to three years and six months for the crime of organizing cheating in the exam.

[Regulations] The Criminal Law of the People's Republic of China clearly stipulates that in national examinations prescribed by law, "organizing cheating", "selling or using wireless cheating equipment", "providing test questions and answers to candidates", and "taking the test on behalf of others or letting others take the test on their behalf" are all illegal acts. The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases of Organizing Cheating in Examinations and Other Cases clearly states that organizing cheating in national education examinations such as college entrance examinations and postgraduate entrance examinations will be directly identified as "serious" behavior and will be sentenced to fixed-term imprisonment of not less than three years and not more than seven years and a fine.

[Reminder] In recent years, local public security organs have worked with education departments to maintain a high-pressure crackdown on all kinds of illegal and criminal activities related to exams, with a "zero tolerance" attitude. Candidates must strengthen their legal awareness, refuse to cheat in exams, and never test the law.

Taking exams for others is not a shortcut, but a "desperate situation"

In order to get their children into their ideal universities, some parents try every possible means, spending a lot of money to find "ways" for their children, or even hire "gunmen" to take the exam for their children. As a result, they lose both money and people, and the consequences are very serious.

In the end, Liu, a graduate student at a certain school, agreed to take the exam for Xiao Chen. As a result, on the day of the 2019 college entrance examination, Liu was caught on the spot by the invigilator. The police immediately opened a case for investigation, and the persons involved in the case were brought to justice one after another. Li organized candidates to cheat, constituting the crime of organizing cheating in the examination, and was sentenced to three years in prison and a fine of 30,000 yuan. "Gunman" Liu took the exam on behalf of others, constituting the crime of taking the exam on behalf of others; parents of students asked others to take the exam on behalf of their children, which also constituted the crime of taking the exam on behalf of others. They were sentenced to five months of detention and fined between 4,000 yuan and 10,000 yuan.

Moreover, the crime of taking the exam on behalf of others is a typical opposite crime. The Criminal Law punishes both the examinee and the "gunman", and the conviction and statutory penalty are the same.

[Regulations] The college entrance examination is a national education examination stipulated by law. The Measures for Handling Illegal National Education Examinations clearly stipulate that the use of communication equipment during the examination shall be deemed as cheating in the examination, and the scores of all subjects registered for the examination shall be invalid. The Education Law of the People's Republic of China clearly stipulates that if a candidate carries or uses cheating equipment or materials during a national education examination, and the circumstances are serious, the education administrative department shall order him to stop participating in the relevant national education examination for more than one year but less than three years; if it constitutes a violation of public security management, the public security organ shall impose public security management penalties in accordance with the law; if it constitutes a crime, criminal liability shall be pursued in accordance with the law.

[Reminder] In order to prevent and combat cheating using mobile phones in national education examinations and further strengthen the comprehensive management of the examination environment, in 2022, the Ministry of Education, the Ministry of Public Security, and the Ministry of Industry and Information Technology jointly deployed local education, public security, communications, radio management and other departments to take a number of measures to carry out special governance to "combat mobile phone cheating". Candidates must know the law and abide by it, take the exam honestly, and never take chances, so as not to ruin their future.

Look for official logos and don’t believe in “rumors”

Every year before the exam, a large amount of information related to the exam is spread online, and all kinds of information are mixed. In order to attract attention, some individuals or training institutions take the opportunity to register "copycat" public accounts, spread "rumors" from unofficial sources, and seek profits from them.

[Case] ​​The 2020 college entrance examination was postponed for one month due to the epidemic. From time to time, some self-media took the opportunity to spread some so-called college entrance examination arrangement information online. For example, some self-media used the title "Arrangement of the 2020 College Entrance Examination in a Certain City" to spread false information about "the 2020 College Entrance Examination in a Certain City" online, misleading the public and causing anxiety among candidates and parents. The city's education bureau determined that the news was false information.

[Regulations] According to the Central Cyberspace Administration's "Internet User Account Name Management Regulations" and "Internet User Public Account Information Service Management Regulations", any Internet user account name registered and used by any organization or individual shall not spread rumors, disrupt social order, or undermine social stability; public account producers and operators shall not maliciously impersonate, counterfeit, or misuse organizations and other people's public accounts to produce and publish information content, and shall not fabricate false information, distort the truth, and mislead the public. Those who violate laws and regulations will be severely dealt with in accordance with the law and contract.

[Reminder] In 2022, the Ministry of Education, together with the Cyberspace Administration of China, the Public Security Bureau and a number of Internet companies, will continue to carry out special operations to "light up the official website logos of authoritative examination and enrollment institutions" and "clean up Internet public accounts related to examinations" so that candidates and parents can timely, comprehensively and accurately understand the college entrance examination information of authoritative institutions and avoid being deceived. When candidates and parents search for information related to the college entrance examination online, please look for the "official" logo of the authoritative institution and beware of fake accounts or website scams.

Don't believe in false propaganda and beware of being deceived

"Guaranteed passing" in the exam, double improvement, quick learning in XX days, or exclusive "internal resources", lectures by "question experts", guaranteed "one-time passing", etc. Such slogans and recruitment advertisements often appear in the recruitment publicity of various examination training institutions, making many parents believe them to be true. In fact, there are varying degrees of violations of regulations and laws such as exaggerated publicity, fictitious teachers, price fraud, and false advertising.

[Regulations] The Advertising Law of the People's Republic of China clearly stipulates that education and training advertisements shall not contain the following content: (1) any explicit or implicit guarantee regarding promotion, passing examinations, obtaining academic degrees or certificates, or the effectiveness of education or training; (2) any explicit or implicit statement regarding the involvement of relevant examination bodies or their staff or examination question setters in education or training; (3) any use of the name or image of scientific research units, academic institutions, educational institutions, industry associations, professionals, or beneficiaries for recommendation or certification.

[Reminder] Candidates and parents should not believe in false advertisements, as this will not only cause property losses but also waste precious review time.

Be aware of online fraud, and do not buy answers to the college entrance examination

Every year, criminals sell so-called "real college entrance examination questions" and "top secret answers" on online platforms or communication groups, touting tempting information such as "extremely high accuracy" and "refunds for breach of contract", and asking users to pay first in the name of "prepayment of deposits". Some also send viruses to users' computers or mobile phones in the name of sending "sample test papers" to obtain user information.

[Case] ​​In March 2021, Huang entered multiple chat groups through QQ, falsely claiming that he had channels to buy answers to the college entrance examination, and sold the so-called "college entrance examination answers" to parents and candidates at a price of 15,000 yuan per subject, defrauding more than 10 people in five provinces including Anhui, Shandong, and Hunan, and defrauding more than 100,000 yuan. At present, Huang has been criminally detained by the police in accordance with the law, and the case is under further investigation.

[Regulations] The Criminal Law of the People's Republic of China clearly stipulates that in national examinations prescribed by law, "illegally selling or providing test questions or answers to others in order to cheat in the examination" is an illegal act.

[Reminder] College entrance examination questions are classified as top secret materials of the state, and their storage and transportation are subject to extremely strict management measures. Candidates and parents must keep their eyes open, distinguish true from false, and beware of fraud.
