The new version of the National Medical Insurance Drug List will be officially implemented nationwide on January 1, 2022.

After this adjustment, a total of 74 new drugs were added to the catalog, including 67 exclusive drugs transferred in through negotiation and 7 non-exclusive drugs transferred in directly. Among them, the average price reduction of the successfully negotiated exclusive drugs was 61.71%.

Compared with the original market price, through negotiated price reductions and medical insurance reimbursement, it is estimated that the cumulative burden on patients can be reduced by more than 30 billion yuan in 2022.

The standard requires that the elderly should undergo a service safety risk assessment before entering a nursing home, and proposes that the scope of the service safety risk assessment should include nine aspects, including choking, accidental ingestion of food and medicine, pressure sores, burns, falling out of bed, falls, injuries to others and self-injuries, getting lost, and accidents during cultural and recreational activities. At the same time, the eight nursing home service industry standards formulated around the "Nine Preventions" requirements of the "Specifications" will all be officially implemented on January 1, 2022.

The "Interim Provisions on Medical Benefits Guarantee for Military Personnel and Military-Related Personnel" will come into effect on January 1, 2022.

The "Regulations" clarify the medical treatment for soldiers and military-related personnel receiving treatment in military medical institutions, define the specific circumstances in which soldiers seek medical treatment across the military and local areas, open up channels for soldiers and their families in units far away from military medical institutions to seek medical treatment at nearby local medical institutions, implement free medical care for spouses of soldiers, preferential medical care for parents of officers and non-commissioned officers and their spouses' parents, and continue to implement free medical care for soldiers and their minor children.

"Bring up children according to the law"! Family Education Promotion Law comes into effect

The "Family Education Promotion Law of the People's Republic of China" will come into effect on January 1, 2022.

Parents or other guardians of minors shall reasonably arrange the time for minors to study, rest, play and exercise, avoid increasing the learning burden of minors, and prevent minors from becoming addicted to the Internet. The local registration requirement for the Putonghua Proficiency Test has been cancelled

The "Regulations on the Management of the Putonghua Proficiency Test" will officially come into effect on January 1, 2022.

The Regulations clearly state that the interval between the two tests will be removed, the registration requirement for the place of residence will be cancelled, and that candidates can register for the test at a location that is nearby and convenient according to their actual needs. Grade A must be certified by a national testing agency, and Grade B and below must be certified by a provincial testing agency.

Delaying the wages of migrant workers? Or you may be put on the dishonest "blacklist"!

According to the "Interim Measures for the Management of the List of Subjects of Joint Punishment for Breach of Trust in Withholding Wages of Migrant Workers" formulated and issued by the Ministry of Human Resources and Social Security, starting from January 1, 2022, employers who withhold or unreasonably withhold wages from migrant workers may be included in the "blacklist" of breach of trust.

For example, the "New Three Guarantees" stipulates that quality issues of special components such as power batteries and driving motors should be included in the three guarantees for vehicle return and exchange terms, and the three guarantees will be implemented for household pickup trucks, and the main components of household car pollution control devices will be included in the major quality issues.

Adjustment of import and export tariffs on some commodities

Starting from January 1, 2022, China will implement temporary import tariffs lower than the most-favored-nation tariffs on 954 commodities, including zero tariffs on the new anticancer drug radium chloride injection, and lower import tariffs on some medical products such as intracranial thrombectomy stents and artificial joints.

Starting from January 1, 2022, within the scope of China's commitment to join the World Trade Organization, import and export tariffs on some commodities will be increased. Among them, the temporary import tariffs on some amino acids, lead-acid battery parts, gelatin, pork, and meta-cresol will be cancelled and the most-favored-nation tariffs will be restored; in order to promote the transformation and upgrading of related industries and high-quality development, the export tariffs on phosphorus and crude copper will be increased.

The "Regulations on the Supervision and Administration of the Production and Operation of Cosmetics" will come into effect on January 1, 2022.

The smallest sales unit of cosmetics shall have a Chinese label. The label content shall be consistent with the product label sample in the registration or filing materials of the cosmetics. The name, ingredients, efficacy and other matters marked on the label of the cosmetics shall be true and legal, and shall not contain any content that explicitly or implicitly indicates that the cosmetics have medical effects, or any content that is false or misleading, violates social order and good customs, or violates laws and regulations.

At the same time, the "Regulations on the Supervision and Administration of Children's Cosmetics" will come into effect on January 1, 2022. From May 1, 2022, children's cosmetics that apply for registration or filing must be labeled in accordance with the "Regulations"; if children's cosmetics that have previously applied for registration or filing have not been labeled in accordance with the "Regulations", the cosmetics registrants and filers shall complete the update of product labels before May 1, 2023.

The "Measures of the People's Republic of China for the Administration of Import and Export Food Safety" will come into effect on January 1, 2022.

Imported food that passes the customs conformity assessment will be allowed to be imported. If the imported food fails the customs conformity assessment, the customs will issue a certificate of non-compliance; if it fails in safety, health, or environmental protection items, the customs will notify the food importer in writing and order it to destroy or return the food; if it fails in other items, it will be allowed to be imported only after it meets the conformity assessment requirements after technical treatment. If the relevant imported food cannot complete the technical treatment within the specified time or still fails to meet the requirements after technical treatment, the customs will order the food importer to destroy or return the food.

Strict trademark management! New intellectual property regulations are introduced

The "General Trademark Infringement Judgment Standards" will come into effect on January 1, 2022.

The "Standard" has a total of 35 articles, which provide detailed provisions for nine types of illegal acts that violate the trademark management order, including failure to use registered trademarks that must be used as stipulated by current trademark laws, regulations and departmental rules, use of signs that cannot be used as trademarks, use of the words "well-known trademark" in commercial activities, failure of trademark licensees to indicate their names and place of origin of goods in accordance with the law, changing registered trademarks, registrant names, addresses or other registration matters at will, using unregistered trademarks as registered trademarks, failure to fulfill collective trademark and certification trademark management obligations, failure to fulfill trademark printing management obligations, and malicious application for trademark registration.
