1. How to calculate salary for working from home?

Wages are paid according to normal working hours.

The Beijing Municipal Bureau of Human Resources and Social Security has made it clear that if companies require employees to work from home through flexible means such as the Internet or telephone, their wages will be paid according to the salary income during normal working hours.

Jiangsu also proposed that if enterprises require employees to provide normal labor through remote work or other forms, they should pay wages in accordance with the law.

2. Can I still receive salary while being quarantined?

Salaries will be paid as usual during the quarantine period. The opinions clearly state that for employees who are unable to provide normal labor due to being quarantined in accordance with the law, enterprises should be guided to pay their wages according to normal labor; after the quarantine period, for employees who still need to stop working for treatment, their wages should be paid according to relevant regulations on medical leave.

Notices issued by Beijing, Shanghai, Tianjin, Hubei, Guangdong, Zhejiang and other provinces (autonomous regions and municipalities) also clearly stated that for patients with pneumonia infected with the new coronavirus, suspected patients, close contacts during their isolation treatment or medical observation, and employees who are unable to provide normal labor due to the government's implementation of isolation measures or other emergency measures, enterprises should treat them as providing normal labor and pay their wages, and shall not terminate the labor relationship.

3. How should wages be paid for overtime work during the Spring Festival statutory holiday?

Pay wages not less than 300% of the original salary.

Sichuan, Yunnan and other provinces have made it clear that during the Spring Festival statutory holiday (January 25-27), employees who cannot take leave due to epidemic prevention and control should be paid no less than 300% of their original salary in accordance with the provisions of the Labor Law.

4. How will wages be paid during the period of waiting for work?

Living expenses will not be paid if the employee has not been to work for more than one salary payment cycle. The opinion proposes that during the period of delayed resumption of work or non-return to work due to the epidemic, for employees who have used up all types of leave and still cannot provide normal labor or other employees who are unable to provide normal labor, enterprises should be guided to refer to the relevant national regulations on wage payment during shutdowns and production stoppages to negotiate with employees, and pay wages in accordance with the standards stipulated in the labor contract within one wage payment cycle; if it exceeds one wage payment cycle, living expenses should be paid in accordance with relevant regulations.

The living expenses standards are not exactly the same in different places. For example, Beijing stipulates that during the period of waiting for work, enterprises should pay basic living expenses at a rate not lower than 70% of the Beijing minimum wage standard; Guangdong stipulates that if an enterprise does not arrange work for employees, it should pay employees living expenses at a rate not lower than 80% of the local minimum wage standard; Shaanxi stipulates that if employees do not provide normal labor, the enterprise should pay living expenses at a rate not lower than 75% of the local minimum wage standard.
