Because of the full use of the results of big data, machines are getting closer and closer to humans in terms of perceptual intelligence. Artificial intelligence has gradually established its own ecological pattern around the world. Due to a series of layouts by technology giants and the open source of various platforms, the threshold for artificial intelligence has gradually been lowered, and companies have significantly increased their investment in artificial intelligence. On the one hand, they have recruited top talents, and on the other hand, they have increased investment and frequent mergers and acquisitions. This shows that the spring of artificial intelligence has arrived. While many people are delighted with the development of artificial intelligence, the legal issues that come with it also need to be answered urgently. Is it illegal for a toy manufacturer to open an experience store to promote AI sex doll robots? Recently, sex doll manufacturer RealDoll will launch an artificial intelligence sex doll robot worth $10,000, which is expected to be launched in April this year. RealDoll CEO McMullen said in an interview: We developed the HarmonyAI system to enable users to establish a new relationship with the simulation doll. Many customers give the dolls ideal personalities to a large extent through their imagination. However, although with such a sex robot, customers no longer have to rely on imagination, the legal issues that come with it are also worthy of people's attention. I believe that once this robot is on the market, those who focus on profit will definitely want to buy a few robots to open experience stores. So the question is, if what I said is really true, is this practice illegal? Our country's laws clearly stipulate that those who solicit prostitution in public places shall be detained for less than five days or fined less than 500 yuan, and those who fail to correct their behavior after repeated warnings will be punished more severely. However, this law currently seems to only target people, and does not make clear provisions for artificial intelligence robots. If it is illegal to open such an experience store, then the owner will definitely not accept it, because there are no relevant laws and regulations. If it is not illegal, then such an experience store is no different from a brothel from ancient times to the present. Although such sex robots are relatively expensive, they are nothing for people in China who are willing to experience new things. Therefore, it is key to improve the laws and regulations on artificial intelligence as soon as possible. If robots rebel and kill people, who will be held responsible if an artificial intelligence accident occurs? I remember in the movie "I, Robot", as the computing power of robots continued to improve, some robots lost control and learned to think independently, and they solved the control code and attacked humans. Unexpectedly, this scene in a science fiction movie actually happened in reality. In July 2015, a robot killed a human worker in the Volkswagen factory in Germany. At that time, the 21-year-old worker was installing and adjusting the robot, which suddenly hit the worker in the chest and crushed him on a metal plate. The worker died on the spot. Although the three laws were set in the movie, they still failed to prevent the robots from rebelling. The same is true in reality. We develop robots to make them smarter and better serve us. However, when their development exceeds a certain threshold, they are likely to become a new individual with rights and self-awareness. At this time, will this new species that has never appeared in human history be content to just serve humans? Will they be willing to follow the three laws established by humans? What is even more disturbing is that you never know when this time will come, and you don’t know whether the robot serving you actually has self-awareness. However, before this time comes, when AI injures people, we have to face this dilemma: how do we deal with such robots? For such non-natural individuals who have neither self-awareness nor behavioral capacity, who should be responsible, the developer or the user? These are just questions, so the improvement of laws and regulations on AI should have been put on the agenda long ago. Legal issues brought about by artificial intelligence cannot be ignored The current rapid development of artificial intelligence has brought a series of challenges to the existing legal system. my country should establish a complete set of laws and regulations for artificial intelligence as soon as possible. If it is impossible to measure the boundaries, we can refer to the precautionary principle in the environmental laws that have been issued in my country, avoid damage to the environment through comprehensive review and testing, and take corresponding measures before the danger comes. The future of artificial intelligence, the relationship between machines and humans, still lies in humans themselves. Machines are designed by humans, and the use of machines and the impact on society mainly lies in the people who design and manufacture machines. Therefore, the solution to the legal problems brought about by the development of artificial intelligence is still how to regulate the behavior of designers and manufacturers behind artificial intelligence technology. In this regard, we can strengthen the formulation of relevant legal rules, so as to define clear standards for whether artificial intelligence can become a legal subject, and provide timely legal basis for judicial personnel. Artificial intelligence laws should clarify the rights and obligations of developers, operators and users, and ensure the clarity of legal responsibilities in specific cases. At the same time, establish a reasonable mechanism to maintain personal data and privacy rights, strengthen the artificial intelligence program review mechanism, and so on. As a pair of basic categories in legal research, artificial intelligence and legal issues have a broad space for exploration. The pace of exploration is gradually accelerating at home and abroad. Although a complete and independent theoretical system of artificial intelligence and law has not yet been formed, the transformation of legal thinking and the advancement of legal provisions are testing the wisdom of legislators and judicial personnel at home and abroad.
