Waymo withdraws some of its allegations against Uber: 3 of 4 patent lawsuits withdrawn
Beijing time, July 10 morning news, even though Waymo's lawsuit against Uber showed no signs of cooling down, the company narrowed the scope of the lawsuit and withdrew some of the charges filed against Uber. According to Bloomberg, as part of the lawsuit, Waymo withdrew three of the four patent charges. Prior to this, the judge also asked the lawsuit to narrow the scope and focus on trade secrets rather than infringement issues. "We found that after working hard to find that the equipment developed by Anthony Levandowski at Uber infringed Waymo patents," a Waymo spokesperson said in a statement. "The company has assured the court that they no longer use and will not continue to use this device, so we have narrowed the scope of the lawsuit and removed the infringement charges against this device. But if necessary, we still reserve the right to re-litigate." "We will continue to file infringement lawsuits against Uber's current equipment, and we will also continue to file lawsuits for theft of trade secrets. This will not be affected by this withdrawal. We hope to continue to sue." The statement said. The core of the patent infringement issue in the case is Uber's Spider system. Waymo believes that the LiDAR system used to detect surrounding objects was developed using trade secrets stolen from Waymo. Uber said that Spider is no longer in use, but people familiar with the matter said that if Uber continues to use the system, the company will also file a patent infringement lawsuit. On the other hand, Uber believes that Waymo's withdrawal of the lawsuit sends a different signal. "Waymo's withdrawal of three of the four patent lawsuits once again shows that they have over-promised and over-delivered," an Uber spokesperson said in a statement. "Not only can they find no evidence that the 14,000 documents involved in the case were obtained by Uber, they now admit that Uber's LiDAR design is very different from their own. Faced with this harsh reality, Waymo's reasons are simply untenable, so they spare no effort to turn the focus to emotions rather than facts." The reason why Waymo first sued Uber was that former Waymo employee Anthony Levandowski downloaded about 14,000 Waymo confidential information before jumping to Uber. Uber fired Levandowski in May this year after a judge banned Levandowski from working on projects related to the lawsuit. Meanwhile, Waymo submitted another 461 questions last Friday, hoping that Anthony Lewandowski can answer them one by one at the trial this fall. Waymo pointed out in the document that this preliminary list still needs to wait for Uber to provide additional documents for evaluation. The company also expects that Lewandowski may refuse to answer many of the questions on the grounds that he does not have the Fifth Amendment to the U.S. Constitution.
