For workers who have confidentiality obligations, the employer may agree with the worker on a non-competition clause in the labor contract or confidentiality agreement, and agree to provide the worker with monthly financial compensation during the non-competition period after the labor contract is terminated or canceled. If an employee violates the non-competition agreement, he or she shall pay liquidated damages to the employer in accordance with the agreement. Article 25: Except for the circumstances stipulated in Articles 22 and 23 of this Law, an employer shall not agree with an employee that the employee shall bear liquidated damages. |
