1. Dragon Boat Festival holiday schedule 2022

According to the "Notice of the General Office of the State Council on the Arrangements for Some Holidays in 2022" published on the Chinese government website on October 25, 2021, it can be seen that the Dragon Boat Festival in 2022 will be a 3-day holiday. The time is from June 3rd to June 5th. No need to make up classes.

2. Will highways be free during the Dragon Boat Festival in 2022?

The expressway will not be free during the Dragon Boat Festival and normal tolls will apply.

According to the Implementation Plan for Exemption of Tolls for Small Passenger Cars on Major Holidays, it can be seen that tolls are exempted for small passenger cars with 7 seats or less on four national statutory holidays: the Spring Festival, Qingming Festival, Labor Day and National Day. Excludes Dragon Boat Festival and Mid-Autumn Festival.

3. Why are highways not free during the Dragon Boat Festival?

1. Not included in the free holidays: According to the Implementation Plan for Exemption of Tolls for Small Passenger Cars on Major Holidays, the holidays for free highway access are the Spring Festival, Qingming Festival, May 1st Labor Day, and National Day, but the Dragon Boat Festival is not included.

2. Close to the May Day holiday: Generally, the Dragon Boat Festival is about a month after the May Day holiday. In recent years, the May Day holiday has been five days, so most people choose to go home on May Day. However, the Dragon Boat Festival is only a three-day holiday, so fewer people will travel. For those who live a long distance, many people will not choose to go home. Therefore, after analyzing big data, the country decided not to include the Dragon Boat Festival in the free highway toll period.

3. Traffic volume is not heavy: Since the Dragon Boat Festival coincides with the busy farming season and students are taking the college entrance examinations, and there is only a three-day holiday for the Dragon Boat Festival, there is not much traffic on the Dragon Boat Festival Expressway. Therefore, the expressway is not free during the Dragon Boat Festival.

4. Will overtime work during the Dragon Boat Festival be paid triple wages?

Article 44 of the Labor Law provides that in any of the following circumstances, the employer shall pay the employee wages higher than the normal working hours wages according to the following standards:

(1) If workers are arranged to work overtime, they shall be paid wages not less than 150% of their wages;

(2) If workers are arranged to work on rest days and no compensatory rest days are arranged, they shall be paid wages not less than 200% of their wages;

(3) If workers are arranged to work on statutory holidays, they shall be paid wages not less than 300% of their wages.

Therefore, for workers who implement the standard working hour system, if they work overtime on statutory holidays such as the Dragon Boat Festival, overtime pay should be paid at a rate not less than three times the daily wage base. The daily wage base is calculated as follows: monthly salary divided by the number of paid days in a month. This year, the number of paid days in a month after the adjustment of Chinese holidays is 21.75 days. Taking an employee with an agreed monthly salary of 1,500 yuan as an example, his daily overtime base is 1,500 yuan divided by 21.75 days, which is 69 yuan; if the company arranges for him to work overtime on May 1, it should pay him overtime wages of no less than three times 69 yuan, which is 207 yuan. In addition, for irregular working hours approved by the labor and social security department, which allow employees to independently arrange their work and rest time on the premise of clarifying the workload, employers do not need to pay overtime wages.

From the above, we can see that there will be three days off for the Dragon Boat Festival in 2022, which will be on June 3, 4 and 5. In addition, the expressway tolls will be charged normally during the Dragon Boat Festival.
