1. 2022 Farmers’ Retreat Order: Retreat construction workers over 60 years old!

Nowadays, it is difficult to find migrant workers over 60 years old on construction sites, and even those over 55 years old are rare. Up to now, many regions across the country have issued documents to further standardize the age management of employment in construction companies. Shanghai, Tianjin, Shenzhen, Guangdong, Taizhou, Jiangsu, Nanchang, Jiangxi, Jingzhou, Hubei and other places have all made this requirement.

In addition, Article 1 of the "Interim Measures of the State Council on Retirement and Resignation of Workers" (Guofa [1978] 104) stipulates that workers in state-owned enterprises, institutions, party and government organs, and mass organizations should retire if they meet one of the following conditions.

(1) Males who are 60 years of age or above, or females who are 50 years of age or above, and have worked continuously for 10 years or more.

(2) Those who are engaged in underground, high-altitude, high-temperature, extremely heavy physical labor or other work that is harmful to health, and are males aged 55 or above and females aged 45 or above, and have worked continuously for not less than ten years.

II. The latest notice on the dismissal of construction workers aged 60 and above in 2022

1. Shanghai

The change in employment in Shanghai's construction sector originated in 2019, when the Shanghai Municipal Housing and Urban-Rural Development Commission, the Municipal Human Resources and Social Security Bureau and the Municipal Federation of Trade Unions jointly issued a document, clearly stipulating that three types of people, men under the age of 18, men over the age of 60, and women over the age of 50, are prohibited from entering the construction site to engage in construction work. At the same time, it was further stipulated that male workers over the age of 55 and female workers over the age of 45 are prohibited from entering the construction site to engage in underground, high-altitude, high-temperature, extremely heavy physical labor or other special work that affects physical health and is dangerous and risky. In May 2021, the Shanghai Construction Project Safety and Quality Supervision Station issued this work reminder again.

2. Huanggang City, Hubei Province

In 2021, the Housing and Urban-Rural Development Bureau of Huanggang City, Hubei Province also made it clear: It is prohibited to recruit or use three types of people, including people under the age of 18, men over the age of 60, and women over the age of 50, to enter the construction site to engage in construction work in any form.

3. Tianjin

In 2021, the Tianjin Municipal Construction Committee issued a document: Construction units are not allowed to sign labor contracts with men over 60 years old and women over 50 years old. Those who have not signed a labor contract are not allowed to enter the construction site.

4. Nanchang, Jiangxi

In 2021, the Urban and Rural Construction Bureau of Nanchang City, Jiangxi Province issued the "Notice on Further Standardizing the Age Management of Employment in Construction Enterprises", which clearly prohibits the recruitment or use of men over 60 years old and women over 50 years old in any form to engage in high-altitude, high-risk, high-risk, and heavy physical front-line operations at construction sites.

5. Taizhou

On May 27, 2021, the Taizhou Municipal Housing and Urban-Rural Development Bureau announced: In conjunction with the advancement of real-name management, the age management of construction workers is included in the scope of daily supervision and inspection, and patrols. People under the age of 18, men over the age of 60, and women over the age of 50 are prohibited from entering the construction site to engage in construction work.

6. Shenzhen

On May 31, Shenzhen Quality and Safety Center issued a notice on further strengthening relevant measures for construction project safety production. It is strictly forbidden to employ minors (under 18 years old); in principle, workers who exceed the national statutory retirement age (60 years old for men and 50 years old for women) are not employed.

7. Jingzhou

On May 27, 2021, the Jingzhou Municipal Housing and Urban-Rural Development Bureau issued the "Notice on Standardizing Labor Management of Construction Projects in the City." It is prohibited to recruit or use the following three types of personnel in any form to enter the construction site to engage in construction work:

Under 18 years old; males over 60 years old; females over 50 years old.

8. Zhuhai Hengqin New Area

According to the "Notice of the Hengqin New District Ecological Environment and Construction Bureau on Further Standardizing the Age Management of Employment in Construction Enterprises": It is prohibited to recruit or use the following personnel in any form to enter the construction site to engage in construction work: one is under 18 years old; two is men over 60 years old; three is women over 50 years old.
