What is the rank of National People’s Congress deputies? Is there a salary? How were they selected?

Currently, the Fifth Session of the Thirteenth National People's Congress of the People's Republic of China, namely the 2022 National People's Congress, is being held. The number of representatives to the National People's Congress and the method of selecting representatives are prescribed by law. So, what is the level of National People’s Congress deputies? Is there a salary? How were they selected?

1. What is the level of National People’s Congress deputies?

National People’s Congress deputies have no administrative rank.

The National People's Congress of the People's Republic of China is composed of representatives elected from the provinces, autonomous regions, municipalities directly under the Central Government, special administrative regions and the military. Each minority group should have an appropriate number of representatives. The National People's Congress holds a five-year term and meets once a year.

2. Do National People’s Congress deputies receive a salary?

No salary. People's Congress representatives with stable jobs will be provided with wages and other benefits by their units during the session. People's Congress deputies who do not have a fixed salary income will receive allowances from the finance department at the same level (municipal, provincial or national level of the People's Congress where they are located).

Legal basis: Article 33 of the Law of the People's Republic of China on Deputies to the National People's Congress and Local People's Congresses at All Levels: When deputies participate in representative activities arranged by the people's congress at the same level or its standing committee during the recess of the people's congress at the same level, the deputies' units must provide time guarantees.

Article 34 Representatives shall perform their representative duties in accordance with the provisions of Article 33 of this Law. Their units shall treat them as having normal attendance and they shall enjoy the wages and other benefits of their units.

Representatives who do not have a fixed salary income will be given appropriate subsidies by the local finance department when performing their representative duties based on actual circumstances.

3. How are deputies to the National People’s Congress elected?

Representatives of the People's Congresses at the county and township levels are directly elected by voters; representatives of the People's Congresses of provinces, autonomous regions, municipalities directly under the Central Government, cities divided into districts, and autonomous prefectures are elected by the People's Congresses at the next lower level. Deputies to the National People's Congress are elected by the people's congresses of provinces, autonomous regions, and municipalities directly under the central government and by the servicemen's congresses of the People's Liberation Army.

Generally speaking, there is no rank for NPC deputies. Besides, the number of NPC deputies shall not exceed three thousand.
